Please read these Terms of Service ("Terms") carefully. They form a binding legal agreement between you ("you" or "User") and Appliance Pickup ("Appliance Pickup," "we," or "us") regarding your use of our website and services (the "Service"). By accessing or using the Service, you agree to be bound by these Terms.

1. Acceptance of Terms

By accessing or using the Appliance Pickup website and its services, you agree to comply with and be bound by these Terms. If you do not agree to these Terms, you must not use our Service.

2. Description of Service

Appliance Pickup operates as a platform that connects individuals seeking free appliance removal ("Users") with local businesses and partners ("Partners") offering such services. We facilitate the introduction, but we do not directly perform appliance pickups, nor are we responsible for the services provided by our Partners.

3. User and Partner Accounts

To utilize certain features, you may need to provide information through our submission or signup forms.

  • For Users (Appliance Owners): By submitting an appliance pickup request, you agree to provide accurate and complete information. You understand that your contact details and appliance information will be shared with our Partners to facilitate pickup arrangements.
  • For Partners (Appliance Pick-up Businesses): By signing up as a Partner, you agree to provide accurate business and contact information. You are responsible for maintaining the confidentiality of your account access and for all activities that occur under your account. You agree to adhere to ethical business practices when interacting with leads provided by our Service.

4. Payments and Subscriptions (For Partners)

Partners may operate on a per-lead payment model or an unlimited subscription model.

  • Per-Lead Payments: For un-redacted lead details, Partners will be required to make a payment. Payment processing is handled by our third-party payment processor, Stripe.
  • Monthly Subscriptions: Partners may opt for a recurring monthly subscription for unlimited access to un-redacted leads in their service areas. Subscriptions will automatically renew unless cancelled prior to the renewal date.

All payments are non-refundable once processed. Our detailed refund policy can be found in our Refund Policy, which is incorporated into these Terms by reference.

5. User and Partner Conduct

You agree not to use the Service to:

  • Provide false, misleading, or inaccurate information in any form or submission.
  • Engage in any activity that is illegal, fraudulent, or harmful to others.
  • Attempt to gain unauthorized access to our systems or other users' data.
  • Use the Service for any purpose other than its intended use.
  • Disrupt or interfere with the security or integrity of the Service.
  • Infringe upon the intellectual property rights of Appliance Pickup or others.

We reserve the right to suspend or terminate access to the Service for any violation of these guidelines.

6. Intellectual Property

All content, features, and functionality on the Service, including text, graphics, logos, and software, are the exclusive property of Appliance Pickup or its licensors and are protected by copyright, trademark, and other intellectual property laws. Your use of the Service does not grant you any right or license to use any of our trademarks or proprietary materials without our prior written consent.

7. Disclaimers and Limitation of Liability

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR COURSE OF PERFORMANCE.

Appliance Pickup does not guarantee the availability, quality, or performance of any services offered by its Partners. We are not responsible for any disputes between Users and Partners.

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL APPLIANCE PICKUP BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (A) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICE; (B) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICE, INCLUDING WITHOUT LIMITATION, ANY DEFAMATORY, OFFENSIVE, OR ILLEGAL CONDUCT OF OTHER USERS OR PARTNERS; (C) ANY CONTENT OBTAINED FROM THE SERVICE; AND (D) UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT.

IN NO EVENT SHALL THE AGGREGATE LIABILITY OF APPLIANCE PICKUP EXCEED THE GREATER OF (A) THE TOTAL FEES PAID BY YOU TO APPLIANCE PICKUP IN THE SIX (6) MONTHS PRIOR TO THE EVENT GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS ($100).

8. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of Kansas, USA, without regard to its conflict of law principles.

Any dispute, controversy, or claim arising out of or relating to these Terms or the Service, including the breach, termination, or validity thereof, shall be resolved through binding arbitration administered by the American Arbitration Association ("AAA") in accordance with its Commercial Arbitration Rules. The arbitration shall be conducted in Wichita, Kansas.

You agree to waive any right to a jury trial and to participate in any dispute as an individual, and you waive your right to participate in a class action lawsuit or class-wide arbitration.

9. Termination

We may terminate or suspend your access to the Service immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms. Upon termination, your right to use the Service will immediately cease. If you wish to terminate your account as a Partner, you may do so by cancelling your subscription (if applicable) or by contacting us.

10. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion. By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms.
